Wrongful Death Guide

Yes, generally. Colorado law caps non-economic wrongful death damages at $2.125 million, effective January 1, 2025, following 2024’s House Bill 24-1472, which also sets up inflation adjustments every two years starting in 2028. That cap does not apply, however, when the death resulted from a felonious killing, in which case the limit is removed entirely.
